May, 2013: Knight Johnson's James Johnson represented a Tennessee developer in a multi-million dollar loan dispute with a well known FDIC loss-share bank. Mr. Johnson successfully convinced a Fulton County jury that the loss-share bank was liable for significant damages and attorney's fees even though the original lender that breached its loan agreement with the developer failed prior to trial. The jury also released the developer and its members from their multi-million dollar loan obligations.
The loss-share bank appealed the verdict but the Georgia Court of Appeals affirmed the verdict without comment. The bank is currently seeking a writ of certiorari from the Georgia Supreme Court.
